This Master Services Agreement (the “Agreement”) is between House Launch (“House Launch,” “we,” “us”) and the business or individual that creates an account (“you,” “Customer”). By creating an account, purchasing credits, or using the Service, you agree to this Agreement. If you are accepting on behalf of a company, you represent that you are authorized to bind it.
House Launch lets you generate AI renderings of homes from their addresses, retrieve an estimated market value and property facts from third-party and public data sources, compose direct-mail postcards, mail those postcards through a third-party print-and-mail provider, and receive inbound contact from recipients.
House Launch is a tool, not an advisor or principal. We do not list, market, buy, sell, broker, appraise, or finance real property; we do not set your prices, offers, or value ranges; and we are not a party to any transaction you pursue. All outreach is sent by you, in your name, under your control.
You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account and for your team members’ use. You must be legally able to enter contracts and to conduct the real-estate or investment activity you market.
Mailing is priced per mailed postcard. You purchase credits in advance; one credit is consumed per mailed postcard at the then-current rate (currently $1.00 per 6×9 postcard, all-in for print and U.S. first-class postage). Payments are processed by our third-party payment processor. Except where required by law or expressly stated, purchased credits are non-refundable. A render that we are unable to produce is not charged; a mailed postcard is charged when it is submitted to the mail provider.
You are solely responsible for ensuring that everything you send complies with all applicable laws, regulations, MLS rules, and brokerage policies. Without limiting that responsibility, you agree that:
Estimated values, ranges, and property facts are derived from third-party and public data sources and are provided for general marketing purposes only. They are estimates, not appraisals, broker price opinions, or guarantees of value, sale price, or purchase price. You will not represent any value as an appraisal or as House Launch’s opinion of value, and you will present values as estimates with the provided (or an equivalent) disclaimer. Data may be incomplete, outdated, or inaccurate; you are responsible for verifying anything you rely on. You will comply with the terms of any underlying data source and will not strip or misattribute source disclaimers.
Renderings are AI-generated visualizations based on imagery of the property and are approximate. You may use renderings and cards you generate for your lawful marketing. You are responsible for the final content of every card, including all copy, prices, ranges, images, and disclaimers, before you send it.
Postcards are printed and mailed by a third-party provider. We do not guarantee delivery, delivery time, deliverability, or recipient response. You are responsible for return-address accuracy and for honoring opt-out and do-not-mail requests you receive.
When a recipient contacts you (by phone, text, scan, or form), you receive their information to follow up. You are solely responsible for that follow-up and for complying with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, state telemarketing and Do-Not-Call laws, and all other communication and privacy laws. House Launch does not place calls or texts on your behalf and does not provide consent for you to contact anyone.
We own the Service and our software, templates, and brand. You own your uploaded lists and your business content. You grant us a limited license to process your content to provide the Service. Subject to your compliance, we grant you a non-exclusive license to use the renders and cards you generate for your marketing.
The service, renders, estimates, and data are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant any value, offer, response rate, lead, or outcome.
To the maximum extent permitted by law, House Launch will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost deals, or lost data. Our total liability for any claim arising out of or relating to the Service or this Agreement will not exceed the amounts you paid to House Launch in the three months before the event giving rise to the claim.
You will defend, indemnify, and hold harmless House Launch and its affiliates from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the Service, your outreach, your lists, your offers and value claims, or your violation of this Agreement or of any law (including real-estate, advertising, fair-housing, telemarketing, and consumer-protection laws).
This Agreement applies while you have an account. You may stop using the Service at any time. We may suspend or terminate access for violation of this Agreement, for unlawful or abusive use, or as required by a data source or law. Sections that by their nature should survive (including payment, disclaimers, liability, indemnity, and IP) survive termination.
We may update this Agreement and will post the updated version with a new version number and effective date. Continued use after an update means you accept it.
This Agreement is governed by the laws of the State of [governing state to be set by House Launch], without regard to conflict-of-laws rules. The parties consent to the exclusive jurisdiction of the state and federal courts located there, except where applicable law requires otherwise.
If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign this Agreement without our consent; we may assign it to an affiliate or successor. This Agreement is the entire agreement between the parties about the Service and supersedes prior understandings.
